Sole proprietorship-

 Limited liability company (LLC)-

Two partners are required, with one or both partners equipped with DPIN and DSC.

Documents required for (LLC)

  1. Legal Name of Partners
  2. Percentage of partnership for each partner
  3. A Certified Copy of the Passport
  4. Existing Foreign Tax Id Number (Pan Card)
  5. Original Voter ID Card and Driving License (Incase Certified Passport is not available)

Corporation

ROC Filling

The term "ROC filing" refers to the process through which a firm submits audited financial statements and yearly reports to the ROC. It is required by sections 129 and 137 of the Companies Act, 2013 that all businesses submit audited financial statements to the ROC. Following the completion of the Annual General Meeting, a business has 30 days to submit its annual accounts and 60 days to file its annual return in accordance with The Companies Act, 2013. Section 129(3) and 137 of the Companies Act, 2013 as read with Rule 12 of the Company (Accounts) Rules, 2014 control the ROC filing of annual accounts, and Section 92 of the Companies Act, 2013 as read with Rule 11 of the Companies (Management and Administration) Rules, 2014 rule the annual return.

  1. Documents Required for ROC Annual Filing
  2. Balance-Sheet: Form AOC-4 is to be filed by all companies while ROC is filing.
  3. Profit & Loss Account: Form AOC-4 is to be filed while ROC filing by all companies.
  4. Annual Return: MGT 7 to be filed by companies. Cost Audit Report: Form CRA 4 is to be filed by the companies.
